1. Whether the fact that Respondent, Maverick Tube Corporation, fabricated false
(fraudulent) evidence of a photograph of a truck in the foreground with unstrapped pipe that
Maverick alleged to be Petitioner's truck, which it was not, is evidence of pretext to discharge
Petitioner.
2. Whether the appointment of a special supervisor, Randy Tune, to observe Petitioner
and create a paper trail to replace Petitioner's immediate supervisor, James Cooper, is evidence of
discrimination.
3. Whether the treatment of the evidence by the lower courts, including, but not
limited to, the discharge of Petitioner, black, who was on the verge of retirement and/or disability
and replacing Petitioner with a white former employee who had previously caused the death of
another employee was a denial of Petitioner's rights of due process and equal protection guaranteed
by the Fourteenth Amendment to the United States Constitution.
4. Whether Petitioner's discipline, discharge, for alleged failure to follow safety
instructions compared to Mike McCraig, white, for being involved in the accidental death of
another employee, is direct evidence of discrimination; Mike McCraig replaced Petitioner
Whitehorn.
