Sandra G. Hale v. United States, et al.
Petitioner and veteran Ms. Hale, sued under 28 U.S.C. § 1346, Federal Tort Claims Act for injuries caused by Veteran's Administration x-ray technician Edward Boulay. The Texas Continuing Tort Doctrine was applied to accrual and discovery date of medical injuries and found not to affect the statute of limitations for filing a FTCA administrative claim. The claims were dismissed with prejudice under Fed. R. Civ. Proc. 12(b)(6). The Fifth Circuit Court of Appeals affirmed.
