Illinois Public Transit Gun Ban Heads to Conference Again

Case: Benjamin Schoenthal, et al. v. Kwame Raoul, Attorney General of Illinois, et al., No. 25-541

Lower Court: Seventh Circuit

Docketed: 2025-11-04

Status: Pending

Question Presented: Whether Illinois' flat ban on ordinary citizens carrying firearms on public transportation violates the Second and Fourteenth Amendments.

The Court distributed Schoenthal v. Raoul for its March 20, 2026 conference, following the submission of petitioners’ reply brief on March 3. The full docket is available at the Supreme Court and tracked on CourtListener.

Illinois law categorically prohibits ordinary citizens from carrying firearms on public transit. Petitioners, represented by David H. Thompson, challenged the statute as inconsistent with the Second and Fourteenth Amendments. Respondents, including Illinois Attorney General Kwame Raoul, filed opposition briefs on February 17.

The National Rifle Association and allied organizations filed an amicus brief in support of the petition. The decision whether to grant or deny certiorari at the March 20 conference will be worth watching closely by anyone tracking the Court’s evolving Second Amendment docket.
