Dicks and in all to Judge Susan Waters Order to Dismiss Civil Action Complaint?

Did the Ninth Circuit Court of Appeals err in not reading the Motion filed One Day late as not in the Rules of Service ex parte and did not allow any time limits against me when filing in the District Court of Appeals err in consideration of the fact how if when read even being prohibited at all to object to Dicks in not taking the Motion?
