This case presents two important questions regarding the Clean Water Act: 1) whether the Ninth Circuit erred by determining that a pipe is not a "point source" when the statutory definition of point source includes "any pipe" and, 2) whether the Ninth Circuit erred by determining there is no direct discharge when a defendant pollutes groundwater and then coveys the polluted groundwater from a pipe directly into waters of the United States.
